U.S. presidential candidate Mark Everson challenges debate exclusion

U.S. Republican Party presidential candidate Mark Everson, former commissioner of the Internal Revenue Service (IRS), filed a complaint on Monday with the Federal Election Commission (FEC) to challenge his exclusion from Thursday’s first Fox News Republican Party presidential debate. Everson argues his exclusion violates Title 11 of the U.S. Code of Federal Regulations in that debate hosts must not “structure the debates to promote or advance one candidate over another”, and must “use pre-established objective criteria to determine which candidates may participate in a debate.”

Everson served as Commissioner of the IRS from 2003 to 2007, during the George W. Bush administration. After his departure, he briefly served as CEO of the American Red Cross, worked in the cabinet of Indiana governor Mitch Daniels, and worked for the tax consulting firm alliantgroup. He announced his candidacy this past March with a sixteen-page open letter in which he outlined the six pillars of his campaign: amnesty for illegal immigrants, reinstatement of the military draft, a promise to serve only a single presidential term, and calls for tax reform, deficit reduction, and corporate responsibility.

Fox News claims Everson fails to meet the criteria it established for Thursday’s two debates. Only seventeen candidates meet the criteria, which require a candidate “consistently” be included in “recognized” opinion polls. The prime-time event features the top ten candidates by average polling percentage. The other seven participate in a separate debate just before the prime time event.

In his complaint, Everson urges the FEC to compel Fox News to include him in the second tier debate as the eighth participant.

Everson argues Fox News, in violation of Title 11, “structure[d] the debates to promote or advance one candidate over another” through a July 27 change to its criteria that replaced a pre-existing one percent polling threshold with a threshold admitting those “consistently” included in “recognized” polls. He alleges this was done to ensure the inclusion of the low-polling candidates former Hewlett-Packard CEO Carly Fiorina, former New York governor George Pataki, Senator Lindsey Graham, and former Virginia governor Jim Gilmore, because Fox News recognizes these candidates as “major players.”

Furthermore, Everson argues the Fox News criteria are not “objective,” as Title 11 requires, because they fail to define the terms “consistently” and “recognized” when referring to polls. He asserts he was included in the Republican Party’s online straw poll in May and is the only candidate still listed on that poll who has been excluded from Thursday’s debate.

Election law expert Richard Winger, publisher of Ballot Access News, says Everson is “completely correct” in his challenge. However, he believes Everson only has a chance of success if he actually files a lawsuit rather than simply complaining to the FEC.

Jawbone found in Aruba is not Natalee Holloway’s

A jawbone found in Aruba is not that of missing American Natalee Holloway, who was a recent high school-graduate at the time of her disappearance. Officials confirmed the news after Dutch scientists completed tests on the bone. The jawbone, which also had a wisdom tooth with it, was found by an American tourist close to the Phoenix Hotel. A second bone had also been found by another tourist earlier this month.

The bone was sent to the Netherlands Forensic Institute where scientists completed tests. They compared the bone to dental records given to them by Natalee’s father, from which they confirmed the the bone was not that of Natalee, although it was human. It was said to be unlikely that the bone was Holloway’s as there is no physical evidence that she was murdered.

Beth accepts the forensic conclusions, is emotionally exhausted from the inexplicably long wait, and deeply disappointed in the time and manner in which she learned of the results.

Taco Stein, the Aruban Solicitor General, released a statement after the announcement was made. He commented on the speed of the identification; he said that they had quickly ruled out Holloway because her records had shown that she had her wisdom teeth previously removed.

Tim Miller, the Director of the Texas EquuSearch, released a statement after talking to Natalee’s father. He said “Dave [Natalee’s father] has been in contact with Aruban authorities and spoke with FBI this morning, the agent working the case. Dave believes it is Natalee.”

An attorney for Natalee’s mother, Beth Twitty, released a statement saying “Beth accepts the forensic conclusions, is emotionally exhausted from the inexplicably long wait, and deeply disappointed in the time and manner in which she learned of the results.” He commented on the Aruban authorities saying that “Apparently Aruban prosecutors were more sensitive to media concerns than the painful vigil of a mother.”

Natalee Holloway disappeared on the island in 2005 while on a school trip. She was last seen leaving a nightclub with three men, one of which was later identified as Joran van der Sloot. Van der Sloot was detained twice by police but has never been charged with Holloway’s disappearance. He is currently in Peru facing a different murder charge. Aruban authorities have said that they are checking neighboring islands to find a match for other missing persons.

The unpredictability of the English weather has been there for many years down the ages so much so that it has even found its way into many English literary works. The pristine white blanket covering is an image that has become synonymous with English weather or Snow in London. The moment one tries to conjure up an image of the English weather the words that come to one s mind are frost, snow, gales, sleet, icy winds and that alone is enough to make one shiver even if one is sitting in a warm climate.

December 2010 started on a mild note but it wasnt long before the countrys temperature dipped 2 or 3 C below average with widespread snow fall. This continued right through the month making it a picture perfect white Christmas . A good deal of the country had snow right up to the New Year. An unusually early dumping of snow was the start of brutal weather conditions under freezing temperatures causing severe disruption of traffic leaving passengers stranded at airports and stations. With scores of flights cancelled due to poor visibility, Britain faced the heaviest snowfall in last 50 years.

After an unusual spell warm November 2011, temperatures are low and are all set to plunge some areas in snow in a matter of days. A thick cover of fog finally heralds an end to a balmy autumn and a very wintry blistering week or Snow in UK ahead is the general predictions for the winter season across UK.

General Motors automobile sales plunge by 45%

General Motors Corporation (GM) announced on Wednesday that it saw a 45% drop in United States vehicle sales for its cars in March.

Executives from several auto firms, however, said that there was some hope for the auto industry to stabilise, as car sales rebounded in the last week of March.

“The market is starting to show small signs of life which need to be nourished like seedlings,” said the vice president and chairman of Chrysler LLC Jim Press. “It’s too early to see a trend, but spring shows signs of hope.”

Other automobile manufacturers also saw their car sales slip: Chrysler and the Japanese Toyota both reported a 39% loss, whilst Ford Motor Company sales fell 41%.

Annualised sales of vehicles in the car industry in the US are predicted to have dipped below nine million in March, compared to February’s 9.12 million, which was the lowest number since 1981.

“Auto makers are pulling every lever in their effort to attract buyers, as evidenced by the new programs from Ford and GM. The typical incentive programs simply do not resonate in today’s economy,” Jesse Toprak, an analyst for Edmunds.

Ford shares gained 2.3% to a level of US$2.69 in early trading at US stock markets on Wednesday, while stocks for Toyota’s US depository increased 5.9% to $67. GM shares slipped 1.6% down to $1.92.

U.S. Prohibition Party presidential candidate Jim Hedges of Thompson Township, Pennsylvania took some time to answer a few questions about the Prohibition Party and his 2012 presidential campaign.

The Prohibition Party is the third oldest existing political party in the United States, having been established in 1869. It reached its height of popularity during the late 19th century. The party heavily supported the Eighteenth Amendment to the United States Constitution, which banned the sale of alcohol, and resulted in the US period known as Prohibition (1919–33). It was repealed in 1933. The party has declined since this period, but has continued to nominate candidates for the presidential election.

In 2003, the party split into two factions. Preacher Gene Amondson and perennial candidate Earl Dodge were nominated for the presidency by their respective factions. After Dodge’s death in 2007, the party reunified and named Amondson as its sole presidential nominee for 2008. During the election, Amondson was interviewed by Wikinews. He died in 2009, leaving an opening in the party for 2012.

Jim Hedges is a longtime Prohibition activist, who holds the distinction of the first individual of the 21st century (and the first since 1959) to be elected to a political office under the Prohibition Party banner. In 2001, he was elected as the Thompson Township tax assessor, and was re-elected to the post in 2005. He served until his term expired in 2010. Hedges declared his intent to run for the Prohibition Party presidential nomination on February 18, 2010. This marks his first run for the presidency.

Scottish police force apologises for double-murder by sex offender

Strathclyde Police in Scotland have apologised to the family of Diane Fallon and her daughter Holly after a report heavily criticised the force’s handling of their killer — a known sex offender living next door.

Thomas Smith, now 28, had been given a six month jail sentence in 2006 after a sex attack on a ten-year-old girl. He had been living next door to the Fallons in a small village in Ayrshire for a year at the time of the murders in March 2009. Nobody in the village was aware he was a registered sex offender.

Smith sexually assaulted Diane Fallon, 43, and raped Holly, ten, before strangling them both. He also tortured them. A High Court judge in Glasgow ordered he serve at least 32 years of a life sentence, saying at the time Smith had “set a benchmark of depravity below which it is difficult to imagine any other human being sinking.”

The new report, written by the Lothian and Borders Community Justice Authority’s Robert Thomson, says Strathclyde Police made errors in their handling of Smith, who the police had “correctly” identified as “high risk” as he had attacked two different youngsters he did not know on the same day.

However, the report noted there was little in the way of justification given for this analysis. It also raised concerns that Smith’s side of the story, which contained a denial, was given “plausibility” by the risk assessment and this may have “distracted” police officers responsible for dealing with him. This was “not helpful or necessarily good practice”.

Other criticisms raised were that the police failed to properly consider whether Smith’s new home was suitable for his status and lost chances to return him to custody — as may have happened had he been arrested over possible further violence against women and children. Had this happened, the report notes the murders may have been prevented. It found police found it difficult to monitor him, and the force’s offender management unit had little oversight from management.

Thomson raised “great concern” in noting Smith’s details were not all on the Scottish Intelligence Database. Criticism was also aimed at the legislative situation, with sex offenders “increasingly aware of their rights and the limited powers the police have in relation to their management” and “Officers… personally discouraged from taking innovative action and… less likely to push the boundaries of their police powers in the established climate of litigation and complaint.”

A total of 34 recommendations were made, including some to the Scottish government. Amongst them is a suggestion search warrants might not be needed when dealing with the homes and phones of sex offenders. Other proposals include improved information sharing and increased resources available to monitor convicts.

“We fully accept what the report says and we have made a number of changes since the murders and as a result of the review process,” says Strathclyde Police Assistant Chief Constable George Hamilton. “Lessons have been learned and major improvements have been made.” He says he has met with the family to discuss their report and offer a direct apology.

London court jails man after Dark Web ricin sting

Mr Justice Saunders today imprisoned a man for eight years at the Old Bailey in London after an FBI sting in which he tried to buy ricin on the Dark Web.

Mohammed Ali, 31, from Liverpool, was convicted at trial of attempting to possess a chemical weapon. He told the jury he was “curious” about the Dark Web, which is a largely hidden and difficult to police section of the Internet. Ali said he didn’t realise he had done anything illegal.

Ali was prosecuted under the Chemical Weapons Act 1996 after sending an undercover agent a message reading “Hi, would you be able to make me some ricin and send it to the UK?” He bought 500mg, which has the potential to kill about 1,400, but was sent a dummy package. Counter-terror police in the UK liaised with the FBI.

The powder, which Ali paid for in BitCoin, was actually harmless. Hidden inside a toy car, the package was treated with markers and his face glowed under ultraviolet light, indicating he had handled it. The judge said today there was “real risk” involved.

Ali told his trial he had discovered drugs and guns for sale. Computer analysis showed he had looked up ricin and other poisons; he said he went for ricin simply because it had appeared in Breaking Bad. He also searched for small animals after being advised to test it on a rodent; a to-do list on his computer included “paid ricin guy” and “get pet to murder”.

Mr Justice Saunders said the case called for “a deterrent sentence”, which “will appear harsh to the defendant and his family.” “Everyone needs to know that the possession of a chemical weapon is extremely serious and long prison sentences will follow.”

City to sue owner of partially collapsed 19th century livery in Buffalo, New York

Buffalo, New York — Two weeks after a 19th century stable and livery on Jersey Street partially collapsed and caused 15 homes to be evacuated in Buffalo, New York, residents still do not have answers from the city despite a court order to work with them and come to an agreement on a way to save some or all of the building, Wikinews has learned. Despite the frustration from residents, the city is planning on suing the building’s owner. A rally was held at the stable’s site where residents are hoping to bring more awareness to the situation and gain more support to save the building.

On June 11, a significant portion of the stable’s right side wall collapsed into the yard of a resident’s home. Authorities, including the Buffalo Fire Department were called to the scene to evaluate the collapse and evacuate 15 homes of residents surrounding the stable as a precautionary measure. The following day, the city ordered an emergency demolition on the building, which was stopped by a restraining order residents with Save The Livery (www.savethelivery.com) won on June 14. Two weeks later, five homes are still evacuated and residents don’t know when they will be able to return.

On June 19, Judge Justice Christopher Burns of the New York State Supreme Court ordered a halt to the emergency demolition and ordered the city and residents to come to an agreement to save the building, or at least a significant portion of it. Despite a court date today, no agreement has yet been reached between the two parties.

“It is in the interest of the city to have a safe environment–but also important to maintain a sense of historical preservation,” stated Burns in his June 19th ruling. The court ruled that a limited demolition could take place and that the city was only allowed to remove material in immediate danger to residents and pedestrians, but stated that the demolition could only be performed with “hand tools.” The court also ordered that any rubble which had fallen into neighboring yards when the building collapsed, to be removed. Since then, most of not all the significantly damaged portions of the building or portions in immediate danger of falling have been demolished. The roof has also been removed to put less stress on the stable’s walls.

“Its been over three years since we have been having problems with part of the livery falling down. There was an implosion two weeks ago and suddenly the city wanted to have an emergency demolition,” said Catherine Herrick who lives on Summer Street immediately behind the stable and is the main plaintiff in the lawsuit against the city. Many homes on Summer are small cottages which were used as servants quarters when the stable was in operation, many of which were built in the 1820’s. At least seven homes on Summer border the stable’s back walls. Residents in those homes have significant gardens which have been planted against the building and growing for decades.

“Both parties are to continue to work together to see how we can meet everybody’s needs. This is the third time we have been in that courtroom, and that is what we were basically told to do,” added Herrick who said the rally was held today because this “is Buffalo’s history. Buffalo is a wonderful place to live because of its history and this is a historical, beautiful building and we need to keep those beautiful buildings.”

Herrick states that the city is working with residents, but also believes that its “slow moving” and they are allowing the owner to get away with neglect on the property.

“I believe right now that they are letting the owner get off. The owner was negligent for 20 years, and hasn’t done anything to it despite what he has claimed to say. Now that this is an emergency situation, the city has a lot to say about it,” added Herrick.

Currently the building is owned by Bob Freudenheim who has several building violations against him because its poor condition. He has received at least five violations in three months and residents who live near the building state that Freudenheim should be “100% responsible” for his actions.

Freudenheim gave the city permission to demolish the building on June 12 during an emergency Preservation Board meeting, because he would not be “rehabilitating the building anytime soon.” Freudenheim, along with his wife Nina, were part-owners of the Hotel Lenox at 140 North Street in Buffalo and were advocates to stop the Elmwood Village Hotel from being built on the Southeast corner of Forest and Elmwood Avenues. They also financially supported a lawsuit in an attempt to stop the hotel from being built. Though it is not known exactly how long Freudenheim has owned the stable, Wikinews has learned that he was the owner while fighting to stop the hotel from being built. Residents say that he has been the owner for at least 22 years. Attorneys for Freudenheim confirm that the city is starting proceedings against him for his violations beginning as early as Wednesday June 25. Freudenheim has not released a statement and could not be reached for comment.

Many residents want the building preserved and Herrick states that their engineer can have it stable in “four days” as opposed to the 14-30 days it would take to demolish the building and “at a lesser cost than what it costs to demolish it.”

It will cost the city nearly US$300,000 to demolish the building which is paid for with tax money collected from residents in the city. The Buffalo News reports that fees are approaching $700,000. Though reports say there is a potential buyer of the stable, Wikinews cannot independently confirm those reports.

Residents say the stable was designed by Richard A. Waite, a 19th century architect, and was first owned by a company called White Bros., used as a stable and housed at least 30 horses at any given time. It also stored “coaches, coupes, broughams, Victorias and everything in the line of light livery,” stated an article from the West Side Topics dated 1906. According to the article, The company first opened in 1881 on Thirteenth Street, now Normal Avenue, and later moved into the Jersey building in 1892. The Buffalo Fire Department believes the building was built around 1814, while the city property database states it was built in 1870. It is believed to be only one of three stables of this kind still standing in the country.

At about 1950, the stable was converted into an automobile body shop and gasoline station.A property record search showed that in 1950 at least four fuel storage tanks were installed on the property. Two are listed as 550 square feet while the other two are 2,000 square feet. All of the tanks are designated as a TK4, which New York State says is used for “below ground horizontal bulk fuel storage.” The cost of installing a tank of that nature according to the state, at that time, included the tank itself, “excavation and backfill,” but did not include “the piping, ballast, or hold-down slab orring.” It is not known if the tanks are still on the property, but residents are concerned the city was not taking the precautions to find out.

Wikinews has called the city along with the Mayor’s office several times, but both have yet to return our calls. There are conflicting reports as to the date of the next hearing. According to Herrick, the next hearing is July 1, 2008 though the Buffalo News states the next hearing is July 8. The News also states that Burns will make a final ruling on the stable at this time.

Even the chief security adviser for Microsoft, Ed Gibson, didn’t want to make any predictions about what would happen. Experts just knew that it was set to go off on April 1. Several anomalous happenings were attributed to Conficker including Leroy “Mac” MacElrie who claimed to be the programmer of the Conficker worm and turned himself in to police.
